Do I need a lawyer to mediate?

While it's not required, it is highly recommended you hire a lawyer who understands the rules of evidence and risks of trial.  The mediator represents neither party, but instead facilitates settlement.

Is mediation confidential?

The mediation process is confidentially protected by statute in Texas.  The mediator will share information with the other side only after discussing it with you and determining if it is helpful to the process.

Is mediation binding?

The key to mediation is that it is a voluntary negotiation. Creative results are possible -- saving future litigation costs and avoiding risks. It is often the last opportunity for the parties to control their destiny before giving control up to the lawyers, and Judge or Jury.
